2. User Accounts

Single Sign-On (SSO): The Services utilize a Single Sign-On system for user authentication. It is your responsibility to enforce Two-Factor Authentication (2FA) for all employees accessing the Services to enhance security.
3. Use of the Services
Authorized Use: The Services are intended for use by small to medium enterprises with generally 5 to 500 employees. You agree to use the Services solely for legitimate business purposes.
Currency: Payments may be made in South African Rand (ZAR) or United States Dollar (USD).
4. Payment Terms
Payment Processing: Payments for the Services will be processed through Payfast
Prohibited Actions: You shall not engage in any unlawful or harmful activities while using the Services.
5. Data Ownership and Privacy
Data Ownership: You retain ownership of any data you input into the Services. We may access this data for maintenance and support purposes
Customer Data Security: Enterprise Suite (Pty) Ltd is responsible for ensuring that appropriate security measures are in place to protect customer data from unauthorized access and breaches.
Compliance with POPIA: We comply with the Protection of Personal Information Act (POPIA) in South Africa, ensuring that personal data is processed lawfully and transparently.
6. Data Storage and Security
Data Storage: All data will be stored securely in AWS data centers located in Africa. We implement industry-standard security measures to protect data at rest and in transit.
Security Measures: We employ encryption, access controls, and monitoring systems to safeguard sensitive information against unauthorized access and breaches.
7. Responsibilities of Clients
You are responsible for ensuring that your use of the Services complies with applicable laws and regulations. Additionally, you must implement adequate security measures within your organization, including enforcing 2FA for employee accounts.
8. Support and Maintenance
We will provide reasonable support and maintenance for the Services as needed, including addressing technical issues and providing updates.
9. Liability and Indemnity
Limitation of Liability: We are not liable for any indirect or consequential damages arising from your use of the Services.
Indemnification: You agree to indemnify us against any claims or damages resulting from your use of the Services.
10. Amendments
We reserve the right to modify these Terms at any time. Users will be notified of significant changes, and continued use of the Services constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws applicable in South Africa.

19. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.
20. Entire Agreement
These Terms constitute the entire agreement between you and Enterprise Suite (Pty) Ltd regarding your use of the Services and supersede all prior agreements and understandings, whether written or oral.

22. Feedback and Suggestions

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign or transfer these Terms at our discretion without restriction.
25. Changes to Services
Enterprise Suite (Pty) Ltd reserves the right to modify, suspend, or discontinue the Services (or any part thereof) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
26. Dispute Resolution
Informal Resolution: In the event of a dispute arising out of or relating to these Terms, you agree to first attempt to resolve the dispute informally by contacting us at support@enterprisesuite.africa.
Formal Resolution: If the dispute cannot be resolved informally within thirty (30) days, you agree that the dispute shall be resolved through binding arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA). The arbitration shall take place in South Africa and shall be conducted in English.
27. Limitation on Claims
You agree that any claim arising out of or related to your use of the Services must be filed within one (1) year after such claim arose; otherwise, it is permanently barred.
28. Security Breaches
In the event of a security breach that affects your data, we will notify you as soon as reasonably possible and take appropriate steps to mitigate the effects of such breach. We will also cooperate with you in investigating and responding to the breach.
